同じ立場というより、同一人物を指しています。 initiated は過去分詞で、文の3語目の is と連動して受動態になります。 「開始される」 誰によって開始されるのかと言えば、 the patent holder 「特許保有者」 or 「つまり」「別の言葉で言うと」 an exclusive patent licensee. 「排他的な特許使用権保有者」 ※しかし特許保有者によって独占された市場を守るめの訴訟は勝ち目がないと思います。英文全体として事実を伝えていないと思います。「特許を保有していない無認可者」が相手なら勝訴できるでしょう。

#1です。 前の回答少し不親切だったかも知れないので、訳をつけて捕捉しますね。 「特許訴訟は費用がかさむ試みであり、通常は特許所有者か、独占的に特許の使用権をライセンスされた会社（人）が市場で確保している位置づけを守る時のみに起こされていた。」 前の回答の余談につながる部分なのですが、この文を訳す時に注意が必要なのが、 initiated が過去形になっていること。もう一つはonlyがついていること。 つまり過去は～だけだった。と言う意味で、現在は少し状況が変わっていることを示唆していると思います。 それから、the patent holder とan exclusive patent licensee が同じ立場だと言う時に説明が少し足りませんでした。ligation なので原告と被告がひるのですが、状況次第で特許主張して行使している側が訴えられる場合もあり、質問の文章だと一般化しているので、ひょっとしたら被告と原告で状況によって違う立場になるかも知れません。 ただ、 a market position occupied by xxx なので、特許によって、マーケットのポジションを確保している側で、自分たちのポジションを守るべき側なことがわかり、同じ側の立場であるkとがわかります。

実はこれは最後の段落の文の一部でして、その後になにか続くのかのかもしれないのですが、結論としては特許制度は許されるべきで、researcherは気にしすぎ...というような内容です。よっぽどのことがない限り訴えられないし、訴えられても裁判官は賠償させるような判決をなかなか出さないそうです
