翻訳の勉強をしていて、以下の文章が分かりません。肯定文なのか、否定文なのか、それとも文章が間違っているのか、契約書の中の一文です。Contractor agrees that if the application was unsuccessful for a period of 4 months from interview, or if successful for the duration of an Assignment and for a period of 18 months following the conclusion of the Assignment, Contractor shall not and shall ensure that the Authorised Personnel does not: (a) provide services to the Client or any third party. という分ですが、骨組みはContractor agrees to ensure that the authorized personnel does not provide serviceという風に考えればいいのでしょうか？Contractor shall not and shall ensureで、shall not なの、それともshall なの、どちらという風に頭が働いてしまい、文がまるで理解できません。最初のContractor agrees はずっと後の、Contractor shall not and shall ensureに同意するという風に訳すのでしょうか? なかなか次の文へ進めず、困っています。どうか、ご指導のほどよろしくお願いします。また、文の最初の部分を、authorized personnelが以下のことを行わない事を保証する事に同意するという風に訳した場合、(a)の文は、クライアントやいかなる第三者にもサービスの提供を行わない、と訳すのか、行うと訳すのか、やってはいけない事を(a)から明記しているので、行うとやくすのか。その辺も教えていただけますか? ありがとございます。 Kiem

＃１です。 ＞＞shall not とshall ensureが並んで書かれているこの文章は、契約書的に見て、あるいは英語の文法上正確ではないという理解でよろしいのでしょうか？ いえ、理屈にはあっています、甲にはこうするな、甲は乙がそういうことをしないようにしろ、という訳ですから、表面的には前半が「するな」後半が「しろ」とように見えますが、結局、後半も埋め込まれた文に否定がありますから、意味的にも、文法的にも出来はいいと思います、ただガリガリして滑りの悪い文章ではありますね。

なんだか法学部の一年生が書いたような文ですね。 骨は、「契約者は同意する」 同意の内容は「契約者はXをしない、そして任命された者がXをしないよう確かめる。 X の内容は (a)顧客や第三者に業務提供をする 同意の内容には条件が二つ （１）インタービューから４か月の間に申請が認められない場合 （２）アサインメントの期間、あるいはアサインメントが終わってから１８ヶ月間に認められる場合 拝見したところこういう構造です。だから一口に言えば、「何もするな」ということですね。 訳すれば「インタービューから４か月の間に申請が認められない場合、又は、アサインメントの期間、あるいはアサインメントが終わってから１８ヶ月間に認められる場合、契約者は(a)顧客や第三者に業務提供をしない、そして任命された者が(a)顧客や第三者に業務提供をしないよう確かめることに、契約者は同意する。」 ということのようです。

こんばんはいつもお世話になっています。 英語の参考書に出てきた、東京大学の入試問題です。 "How much and how often we congratulate ourselves upon it [=a sense of humour]..." この文を訳すと「我々は自分たちがユーモアの感覚を持っていることを、どれほど、そしてどれくらい頻繁に、ありがたく思うだろうか」となると思います（完全な直訳ですが）。 しかし参考書の和訳では「我々は自分たちがユーモアの感覚を持っていることを心から、またしばしばありがたく思うのである」と肯定文になっています。どのように考えればこのような意訳になるのでしょうか？ 長い文章で申し訳ありません。 ご回答はお時間のある時で結構です。よろしくお願いします。
