このように法律と業界の構成との間に関連が無い事実は、今まで殆ど調査されないできた。

　1940年にできた投資会社法は、ファンド族の存在を認めていない、だから相互ファンドの理事会は特定のファンドの株主にのみ義務を負い、そのファンド族に属する他のファンドの利益には関知しなかった。

　こういう法律と投資に関する実態とがかけ離れているということは、殆どの場合見過ごされてきた、ということでしょう。
