一語一語調べながらの回答ですので、とりあえず最初の方だけやってみました。 If there is any doubt about the pli-ability of fair use and its four factors, the appellate history of most fair use cases going to the supreme Court since passage of the 1976 act should dispel it:the common pattern is for the Supreme Court to reverse a court of appeals decision that itself reversed a dutifully applying the four factors. 「もし公正使用とその4要素の柔軟性について疑念があったとしても、1976年の法令成立以降最高裁判所まで行った公正使用の訴訟のほとんどの上訴の過去例はその疑念を払いのけるだろう。 その共通パターンは、忠実に4要素を適用したものを覆した上訴裁判所の判決を最高裁判所が覆す、というものだからである」 コロンの後の部分ですが、日本の裁判所の場合で言うと、地方裁判所で出た判決を高等裁判所が覆し、最高裁では高等裁判所の判決をさらに覆して地方裁の判決が正解となる、ということではないでしょうか。4要素を忠実に適用した地方裁の判決が最高裁判所で認められる、ということだと思いました。
