merits of the case ですが、法律用語のようです。 case は 訴訟 です。 merits は 本案 。 以下はアルクからの引用。 《merits》《法律》〔訴訟の〕本案◆訴訟の形式的側面などを除いた事実（実体）的側面を指す言葉。 日常生活でつかう、メリットがあるとか、そういう意味ではないようです。私は法律は分からないので、具体的にどういうのが本案かは分かりませんが。。。 また、なにかありましたらご質問ください。

> つまりthe caseというのは、eitherの中で話されているそれぞれのケースということですよね。（recuseする場合とそうでない場合） 本当はa written explanation of either.. 全体にかかると思います。ただ、意味を取るときに実際にはそれぞれのケースとしても大差ないと思います。 「このケース（この案件、事案）のメリットを基本とした」なので、the reasons とか、the legal basis にかかるとしてしまうと、その後でそれぞれfor ...と制限しているのに、based on the meritsがかかってくると更にバイアスがかかるような印象があります。それよりは、どっちの判断にせよ、基本はこの案件のメリットだ、と言うことだと思います。

either は、the reasons とthe legal basis のどちらかと言う事になります。if の文は、この条件が成り立てば、the legal basis と言う条件を示すために挿入されています。 recuseするのはjudgeでだと思いますが、recuseは他動詞なので本来であればrecuse himselfかherselfが来るべきで、ただ自明なので落としているのかと思います。 この文、訳すとかえってわからなくなるので、下記の様に整理してみました。 ・この信頼出来ないやり方は置き換えられるべきだ。 ・それは次の1., 2.のどちらかを説明した書面による要求によってなされるべきだ。 1. 裁判官がこの件に関与しない理由 2. （もし、裁判官がこの件に関与しないことに反対するのなら） その判断に至った法的根拠 ・それぞれそうすることの利点を元にして説明されるべきだ
