The prior art made of …の定訳をアドバイスしてください
●米国特許庁のOffice Actionによく出てくるThe prior art made of record and not relied upon is concidered pertinent to applicant’s disclosure. という文章を、（記録にはあるが（拒絶の）根拠としては表示していない先行技術も、申請人の開示に関連しているものであるとみなす。）と訳しました。 ●これは正しいでしょうか。定訳があるようにも思いますので、アドバイスお願いします。 ●… record and not …のandを、but（しかしながら）の意味に訳して良いのでしょうか。

まだ締め切られていないということは、回答に納得していないということでしょうか？ applicantは「申請人」じゃなくて「出願人」と訳した方がいいです。特許の世界では「申請」という言葉は使わず、「出願」と言います。 一応No.1の方が紹介されているサイトにおける解説で理解はされたと思いますが、さらに内容を考えていくと、 「下記（上記）の先行技術文献は、本願発明と関連性があると考えられるが、今回の拒絶理由の根拠とするものではない。」 のような訳文の方が頭にすっと入ってくるのではないでしょうか。 国内企業や特許事務所に翻訳の仕事を依頼されたということでしたら、そんなお決まりの部分は重要じゃありませんから、内容さえわかればＯＫです。文法通りに訳すよりも意訳した方が、翻訳者としての評価が上がる可能性もありますよ。

機密保持情報を訳しているのですが、文法が分からない箇所があります。 Recipient shall only use the Confidential Information for the purpose of wafer foundry business or other purpose(s) identified by discloser upon disclosure and is prohibited from using such Confidential Information fo r any other purpose. 受領者は開示情報を、wafer fondry business もしくは開示者が特定したその他目的のみに使用するものとし、その他目的のために当該機密情報を使用することを禁止するものとする。 upon disclosureをどう訳していいのか分からず抜いてしまいました。 また、is prohibited ～はどこにかかるのでしょうか。 よろしくお願いします。

秘密保持契約の和訳をしていますが訳しにくい文があります。 1点目 For purposes of this agreement,information which can be readily shown to have been already known to recipient or generally known to the public,before disclosure to recipient by or with authorization from disclosure,shall not be treated as confidentioal proprietary information of disclosure という文の中で特にwhich以下のshallまでの節がどのような構文になっているのかわからず訳しにくいです。 単語から推測して「情報提供者の許諾によって被情報提供者に開示する前に容易に閲覧可能であり既に被情報提供者に知られているか一般的に知られている情報」となるかと思ったんですがあっているでしょうか? 2点目 recipient agrees not to make,use,or sell or disclose to others confidential information without first obtaining written authorization from disclosure to do so. という文で使われているmakeは「作る」ではしっくりこないのですが何か別の意味があるのでしょうか?ちなみに「被情報提供者は情報提供者からの文面による許諾なしに機密情報を他へ作成・使用・販売・開示しないことに同意する。」と訳したのですが問題ないでしょうか？ 3点目 recipient agrees not to encourage any third party to make,use or sell confidential information to implement it or an equivalent thereto,without first obtaining and receiving written authorization from disclosure to do so と言う文を「被情報提供者は情報提供者からの文面による許諾なしに、履行またはそれと同等の目的で第三者が機密情報を作成・使用・販売・開示することを促さないことに同意する」と訳したのですが問題ないでしょうか？特にimplementの訳と、どこにかかっているのかがよくわかりませんでした。 1点だけでもよいのでよろくしおねがいします。
