ごめんなさい。間違いました。 (2) 「しっかり見て間違いに気づかなかった被告が悪い」と主張されると、結構原告が不利だと思います。 これは間違い。 正しくは 「しっかり見て間違いに気づかなかった原告が悪い」と主張されると、結構原告が不利だと思います。 正しくは「原告が不利だと思います」でした。

(1) 被告がどんな申し立てをしたか、詳しいことは何も書いてないわけですから、却下の理由を想像するのはなかなか難しいと思います。 勝手な想像でよければ、おそらく、本格的な審理に入る前の前哨戦として、被告が手続き上の不備か管轄違いを主張したが、裁判所は認めなかったということじゃないでしょうか。 いずれにしろ、ニュース全体の主旨は「訴訟が提起された」ということ。 被告が訴訟の門前払いを求めたが、裁判所は認めなかった。だから、これから本格的な争いが始まる…という含みです。 (2) こういうのって、「ちゃんとチケットを渡して確認を求めているのだから、しっかり見て間違いに気づかなかった被告が悪い」と主張されると、結構原告が不利だと思います。 でも、過去に同じ間違いがあったということなら、「通常の注意を払っていても、旅客がチケットの間違いに気づくとは限らない」「他方、そういう間違いが起こる可能性を認識していながら、何も対策を取らず間違いを再発させた被告の過失は重大だ」となって、俄然原告が有利になってきます。

1。 なぜ裁判官は却下したのでしょうか? 詳しくは判決文にあるのでしょうが、以前にも同じことがあれば、構造的な再検討が必要で、航空会社に落ち度がある、と見たからでは無いでしょうか。 2。  「航空会社は以前にも同じ失敗をした」と言っているのだと思うのですが、それがどのような影響をもたらすでしょうか?     何か再発を防ぐ警告が無ければまた起こる、と考えられたのではないでしょうか。
