the fact that S V の場合の that は関係代名詞ではなくて同格の接続詞です。 (1)の位置にaccording toを置くのと(2)の位置に置くのとでは修飾関係が違ってくると思われます。一般的には(1)の位置では本動詞is calledを修飾し、(2)の位置ならthe fact that 以下の節中の動詞is limitedの部分を修飾します。意味を考えるとClauses 18でthe liabilityがis limitedされているのですからthat以下の節中にaccording toを置いたほうが良いわけです。 ご指摘の通り、factとaccordingの間に同格のthatを入れ、Lading とthe liabilityの間にカンマを入れるとわかりやすくなると思います。 ただ、更に深く考察すると同格のthatがあるかないかでニュアンスが違ってくるという説を読んだことがあります。既知の情報にはthatを入れ、新しく導入する情報にはthatを省く傾向があるというのです。つまりthat以下の情報が聞き手にとって全く新しい情報だと話し手が思っている場合、thatが省かれる傾向があるのです。そしてthatを省いた場合にカンマを入れるとaccording toがis calledを修飾しているように見えなくも無いのです。それでこのような形になったのかもしれません。

ありがとうございます。 「ニュアンスが違ってくるという」となると、母国語でない人にとってはわかりにくいですね。 昔教えてもらったとき、関係詞のところで、whoの用法、whichiの用法、thatの用法を教えてもらって、thatは人でも物でも使えるから便利です、と教えてもらった記憶があります。
