訳してしんぜよう respondentは権利関係における甲、乙の乙にあたるとおもい ます。ここでの契約は雇用関係ですので、被雇用者の意味かと おもいますが、仮に、乙と訳しておきます。 乙(被雇用者)は、見習い期間を含めて10年間の職務を完了するに あたり基準にもとづく昇進保証(ACPS)を適用される権利があ るものとされた 乙(被雇用者)3人は、見習いとしての訓練期間を基準に含める べきとの根拠にもとづき、ACPS(基準に基づく昇進保証)の 第二段階が適用されるべきとの最高裁判決をもとめていた。
