商標権に関する契約内容でわからない点が出てきました。 ・sole and exclusive property→「独占的な財産」？ 「sole」も「exclusive」も共に「独占的」という意味があるかと思いますが、この場合一括して訳すのがいいのか、それぞれ別の意味として訳す方がいいのか、どちらが適切でしょうか。 ・effect from time to time→「時々効力のあるものとする」？ 次のような文章で使用されています。 ［英文］ Customer may use the Trademarks only in conjunction with Customer’s sales of the Products and only in accordance with ABC's policies in connection with the sales and promotion of the Products, in effect from time to time. ［訳］ 「取引先」は「取引先」の「商品」の販売に関連している場合にのみ「商標」を使用できるものとし、「商品」の販売およびプロモーションにおける「ABC」のポリシーに従って「商標」を使用できるものとし、時々効力のあるものとする？？ ・return the same→元の状態？元の場所？ 次のような文中で使用されています。 ［英文］ Upon termination of the Contract Period, Customer shall immediately cease using the Trademarks and any marketing materials or other materials containing the Trademarks and return the same to ABC. ［訳文］ 「契約期間」の終了時には、「取引先」はすぐに「商標」の使用を中断し、「商標」が含まれているあらゆるマーケティング材料あるいはその他の材料を元の状態で「ABC」に変換する。

Ｓｏｌｅ ａｎｄ Ｅｘｃｌｕｓｉｖｅ Ｐｒｏｐｅｒｔｙは逐語約をすれば「このトレードマークはＡＢＣ社が単独で排他的に所持するものである」とかなるのでしょうが、このフレーズではＳｏｌｅもＥｘｃｌｕｓｉｖｅもおなじ意味なので（ただ単に法律用語では同じ意味の言葉を並べる習慣があるので習慣通りに使っている。今では決まり文句ですけれどもね。）訳を見る方に意味が通じればというのであれば一括して訳してしまって構わないと思います。 Ｉｎ ｅｆｆｅｃｔ ｆｒｏｍ ｔｉｍｅ ｔｏ ｔｉｍｅ．はＰｏｌｉｃｙにかかっているのではと思います。「その時々に有効であるＡＢＣ社のポリシーにしたがって」でしょう。ＡＢＣ社のポリシーが変わることがあり、ＡＢＣ社のポリシーの変化で使用権利も変わってくるといいたいのでは。 Ｒｅｔｕｒｎ ｔｈｅ ｓａｍｅのＳａｍｅは”Ｔｒａｄｅｍａｒｋｓ ａｎｄ ａｎｙ ｍａｒｋｅｔｉｎｇ ｍａｔｅｒｉａｌｓ ｏｒ ｏｔｈｅｒ ｍａｔｅｒｉａｌｓ ｃｏｎｔａｉｎｉｎｇ Ｔｒａｄｅｍａｒｋ”のことをさします。つまり、契約期間が終わったら、使っていた商標を含んだ広告などを返せとのことです。
