訴訟の行末を待つしか無いと思いますが、個人的にはこの件で橋下氏が勝つとも思えません。確かに虚偽のニュースをリツイートしただけですから、岩上氏自身も被害者と言えるかも知れないしすでに削除している。なので、このリツイートによって橋下氏に実質的なダメージがどれだけあったかが問われるのだと思います。ただ、リツイートとは言え、膨大なフォロワーがいる岩上氏が自分の名前でリツイートすると言うことは、普通のリツイートではなく、岩上氏のブランドによる虚偽ニュースの再生産とも言えて、また内容に岩上氏のお墨付きがついたと言うことなので、影響力は元のツイートよりも大きいかも知れません。そう言う立場の人は慎重になるべきと言う教訓だと思います。私の様な一般人がやったからと言ってこの件で訴えられたり罪になるケースではないです。 しかしながら今世界中で大問題になっているのはSNSでのフェイクニュース。フェイスブックも巨額の費用とAIの導入、何万人もの人員でフェイクの投稿を排除しようとしていますが、今のところ画像を加工した偽の証拠写真を発見する技術が無く、非常に危険です。そう言う環境で多くの人がSNSを使っているので、橋下氏の問題はその中でも小さい一部の話として良いと思いますが、SNSを使う上での啓蒙としては意味があると思います。 スラップ訴訟法の議論に持ち込むにはまだ早いですが、SNSの問題を議論するには良い題材と思います。

Parmenides of Elea c. 510–? 440BC ‘One cannot know that which is not –that is impossible’ Little is known of Parmenides’ life and background, and fragments of a poem entitled On Nature are all that survive of his work. It is not enough for newspapers readers to know what happened. They must also know why it happened and what it will do to their country, their city and themselves. For many years newspapers were only expected to report facts. Readers had to do their own explaining. But most readers did not know enough of what was happening behind the news to be able to explain or understand it. That is why news magazines such as Vision, in Latin America, and others around the world were started. They did the job which most newspapers were not then doing―going behind the news to explain why it happened. Explaining the news is not giving an opinion. It is telling as much as possible about an event to let readers know what caused it. For example, they should know about the downfall of agovernment in Latin America, but should also understand what caused that downfall.
