橋下徹が訴えられた削除済みリーツイートに対して事件が確定判例になればツイーターやFacebookなどの全てのSNSプラットホームを死滅せることになるではないのか? リーツイトやいいねで訴えられないように忖度してSNSは誰も使用しなくなるのでは、以前の職業的な言論人の時代に逆戻りするのではないか? 強者による弱者への言論弾圧(声をあげたことによって訴えられる)、言論の自由に対する妨害抑止(社会に対してものが言いにくなる)と対峙するためにも早急に日本ならびに全世界でスラップ訴訟法を整備しなくてはいけないのではなかろうか? 訴訟の行末を待つしか無いと思いますが、個人的にはこの件で橋下氏が勝つとも思えません。確かに虚偽のニュースをリツイートしただけですから、岩上氏自身も被害者と言えるかも知れないしすでに削除している。なので、このリツイートによって橋下氏に実質的なダメージがどれだけあったかが問われるのだと思います。ただ、リツイートとは言え、膨大なフォロワーがいる岩上氏が自分の名前でリツイートすると言うことは、普通のリツイートではなく、岩上氏のブランドによる虚偽ニュースの再生産とも言えて、また内容に岩上氏のお墨付きがついたと言うことなので、影響力は元のツイートよりも大きいかも知れません。そう言う立場の人は慎重になるべきと言う教訓だと思います。私の様な一般人がやったからと言ってこの件で訴えられたり罪になるケースではないです。 しかしながら今世界中で大問題になっているのはSNSでのフェイクニュース。フェイスブックも巨額の費用とAIの導入、何万人もの人員でフェイクの投稿を排除しようとしていますが、今のところ画像を加工した偽の証拠写真を発見する技術が無く、非常に危険です。そう言う環境で多くの人がSNSを使っているので、橋下氏の問題はその中でも小さい一部の話として良いと思いますが、SNSを使う上での啓蒙としては意味があると思います。 スラップ訴訟法の議論に持ち込むにはまだ早いですが、SNSの問題を議論するには良い題材と思います。
