ドメインの使用権について
個人事業主として、ABC（仮名）という名称でコンサルティングサービスを提供している者です。社名（法人化していません）として「ABC」を使い、ホームページのURLも「xxx@ABC.com」を使用しています。ただし「ABC」の商標登録等はしていません。 インターネット上の知的財産権を管理する中国の会社より以下のメールが届きました。その会社のホームページには、a comprehensive company engaged in the Internet intellectual property services that mainly provides network-based service, network intellectual property service, network promotion service, etc.」とあります。ある企業が「ABC」というブランド名を使用するため、インターネットのドメイン取得の申請をしてきたようです。どのように対応すればよいか、アドバイスいただければ幸いです。 ＝＝＝ We are the department of Asian Domain registration service in china, have something need to confirm with you. We formally received an application on Jan 5, 2011, one company which called "XYZ（仮名） Corp" are applying to register "ABC" as brand name and following Domains: ABC.asia ABC.com.cn ABC.com.hk ABC.com.tw After our initial examination, we found that the brand name applied for registration is as same as your company using name and brand. These days we are dealing with it, hope to get the affirmation from your company. if your company did not authorize the aforesaid company to register these, please contact us as soon as possible. In addition, we hereby affirm that our time limit is 10 workdays. 相手に高く売ればいい。 相手には欲しいと言っているんだから、「売ってやる」ということで金に出来る。～交渉が面倒ですが。 あっさり手放して、別サーバーに切り替え、日本国内の枝のURLに切り替える。～～変わるけど、対外的イメージは維持できる。 ですから、引っ越しの準備をしながら、交渉すればいい。

先日、私が登録しているドメインに絡んで、「そのドメインはうちの登録商標だから移転させて下さい。」 という内容のメールが海外から送信されて来ました。 それに対して、「どうしても必要なら考えます。」と返信しました。 その返答が下記です。 First thank you for your prompt reply. My companies name is ****** and this is a registered trademark in the US. The name ****** is registered at the site www.//////.org the registration no# is ++++++++ you can verify this at the above website. Im sorry that you did not know this but my company has legal copywrite to this name. The solution to this problem is to transfer this name to my company. I will gladly refund the money for the transfer upon you transferring it to my company. I have already contacted the proper internet authorities and they are verifying our trademark status. If you transfer this name to me I will not bring any legal charges against you or your company. Please contact Registrars.com for the proper procedure for transferring this domain to my company. Since both patents cover said product of yours, we except your responce by September 30, 2011 at the latest answering the question as to why you think that these patents are not relevant for your company. 特許侵害しているとまで断定して言ってきているのでしょうか？
