仲裁人は、仲裁判断において、…を含む仲裁費用の負担を決定する。 Awardは「仲裁判断」。 裁判でいうjudgment（判決）に相当するものです。 The arbitratorで単数なのに、their awardのtheirと複数で受けているところが微妙ですね。

For that purpose, AAA shall inform BBB of the credit account at the shipping of its choice. 1文目はサンプルの製造費、2文目はサンプルの承認を得るための輸送費の負担について定めています。わからないのは、3文目の英文の意味です。 他の言語から英語に翻訳された英文のようで、この英語が必ずしも正確と はいえないのですが、契約書を読みなれた方であれば、簡単にお分かりに なる内容だと思い、質問させて頂く次第です。 AAA shall inform BBB of the credit account at the shipping of its choice. の英文は、どのような意味なのでしょうか？ ご指導のほど宜しくお願いします。

以下の英文が翻訳できずに困っています。 おわかりになる方いらっしゃいましたら、ご回答の程宜しくお願いいたします。 (1) In case of development project should a third party claim intellectual property rights such as patents, trademarks, and similar rights against "A", the purchaser of the project shall indemnify "A" all costs such as legal and court costs and any damages resulting from such claim provided that the claim is a result of the purchaser's specifications and requirements. ※文中にshould claimとshall indemnifyの2つの動詞があるように思いますが、 どの様に和訳できますでしょうか。 (2) Any product liability not laid down by law but which has developed in accordance with legal practice concerning compensation is thus explicitly waived. ※ 「法で定められないが補償に関わる、かかる法律実務に従ったいかなる製造責任、明確に放棄される。」と和訳しましたが、legal practiceやconcerning compensationをうまく訳せていない気がします。 (3) The purchaser shall indemnify "A" to the extent that "A" is liable vis-a-vis third parties for any damage or loss for which "A" is not liable vis-a-vis the purchaser in accordance with clause12.1 above. ※ 「買い手は、Aが責任を負う相対する第三者が被った、Aが相対する買い手に責任を負わない、損失、および損害の範囲において上記本契約書第12条1項に従いAに弁済するものとする。」直訳したらこのようになりました。意味が通じないので添削をお願いいたします。 (4) The circumstances mentioned shall only result in force majeure if their influence on the performance of the agreement at the time of the formation of the agreement was not possible to predict. ※ 「本契約の成立時において、契約の履行に及ぼす影響が予測できなかった場合、記載した事情は不可抗力によって生じたものでなければならない。」 以上の4項目に対して添削等をお願いいたします。 宜しくお願い致します。

個別契約に関する項目で、解らない文章がありましたので質問致しました。 "However, any details common to each Individual Contract may be separately agreed upon in advance, and incorporated in a separate common agreement or each individual contract. The terms of such common agreement or individual contracts, as the case may be, shall, wherever in-consistent, with or absent in this agreement, shall supersede this agreement." 下記は私が翻訳した文章ですが、"a separate common agreement "や"as the case may be, shall, "の箇所がうまく訳せませんでした。 特にshallは以降のshall supersedeと重複している様に感じるのですが、shallの直後に動詞が省略されているのでしょうか。 「しかし、各個別契約に共通する任意の詳細は、別途、事前に合意され、共通の同意または各個別契約に組み込むことができる。矛盾や存在しない項目がある際は、場合によって、この共通の合意や個別契約の詳細が優先されなければならない。」 お力添えどうぞよろしくお願い致します。

下記の英文が訳せませんでした。 お力添えお願い致します。 "The failure or delay of either Party to require performance by the other Party of any provision of this Agreement shall not affect its right to require performance of such provision nor shall any single or partial exercise of the same preclude any further exercise thereof or the exercise of any other right, power or remedy." 感覚的な解釈ですが、、、 怠慢や遅延によって、一方の契約者が相手の債務不履行を指摘しなかったとしても、権利放棄にはならない、と言う事を言いたいのだと思いますが、"nor shall ～power or remedy."までがうまく和訳できません。 また、そもそも、私の解釈が正しいのかも確証が持てません。 要所だけでも構いませんので、和訳をお願い致します。
